Terms of Service

These terms are an agreement between you and 1956 US LLC ("Bobb," "we," "us") covering your use of the Bobb platform. By creating an account or using Bobb, you agree to them.

1. The service

Bobb is a platform for building, sending, and growing newsletters and for surfacing and booking sales conversations from your audience. We may add, change, or remove features over time as the product develops.

2. Your account

You must provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be at least 18 and able to enter a binding contract. If you use Bobb on behalf of an organization, you represent that you're authorized to bind it to these terms.

3. Acceptable use and anti-spam

Permission-based sending is the core rule. You agree that:

  • You will only email people who have a relationship with you or have otherwise been lawfully added, consistent with applicable law (including CAN-SPAM, CASL, and GDPR where they apply).
  • You will honor unsubscribe requests promptly and not email anyone who has opted out.
  • You will not use Bobb to send spam, deceptive content, malware, or anything unlawful, infringing, harassing, or harmful.
  • You will not purchased-list blast, scrape without consent, or do anything that threatens the deliverability of the shared sending infrastructure.

We monitor for abuse and may suspend or terminate accounts that put deliverability, the network, or other customers at risk.

4. Your content and data

You own your content, your contacts, and your archive. You grant us the limited license needed to host, process, and send them on your behalf. You can export your list and content at any time — we're not interested in lock-in. You are responsible for having the rights and consents necessary for the contacts you upload.

5. Fees and billing

Paid plans are billed in advance on the cycle you select (monthly or annual). Plans and pricing are described on our pricing page. Fees are non-refundable except where stated (for example, pro-rated refunds on unused annual months) or required by law. We may change pricing with reasonable notice; changes don't apply to a term you've already prepaid.

6. Trials and guarantees

Free trials and any lead-related guarantees are offered on the terms described at signup or on our marketing pages at the time you accept them. We may modify or end promotional offers prospectively.

7. Third-party services

Bobb integrates with third-party services (email delivery, payments, hosting, analytics, and optional self-host keys you provide). Your use of those services is also subject to their terms, and we're not responsible for their acts or omissions.

8. Availability

We work to keep Bobb available and reliable but don't guarantee uninterrupted service. We may perform maintenance and may change or discontinue features.

9. Termination

You can cancel anytime from your account. We may suspend or terminate access for breach of these terms, non-payment, or activity that endangers the platform or others. On termination you may export your data for a reasonable period before deletion.

10. Disclaimers

Bobb is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant specific deliverability, open, click, or revenue results.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your content, your contacts, or your misuse of the service or violation of these terms.

13. Dispute resolution and arbitration

Most concerns can be resolved by emailing us first. If a dispute can't be resolved informally, you and Bobb agree to resolve it through binding individual arbitration rather than in court, and you and Bobb each waive the right to participate in a class or representative action, to the extent permitted by law. Either party may still bring a qualifying claim in small-claims court.

14. Governing law

These terms are governed by the laws of the State of Nevada and applicable U.S. federal law, without regard to conflict-of-laws rules.

15. Changes to these terms

We may update these terms as the product and law evolve. Material changes will be reflected in the date above and, where appropriate, communicated to customers. Continued use after an update means you accept the revised terms.
